Wavemaps Terms of Service  Effective Date: October 12, 2025

1. Acceptance of Terms    

By downloading, accessing, or using the Wavemaps mobile application (“App”), you agree to these Terms of Service (“Terms”). If you do not agree, uninstall the App and do not use it.  

2. Service Description    

The App provides wave, wind, tide, and related environmental forecasts generated from numerical models and partner data feeds (“Services”). Forecasts are for general informational purposes only, not for navigation, safety-critical, or mission-critical decision-making.  

3. Eligibility & Accounts     You must be at least 16. When you create an account, you agree to provide accurate information, keep credentials confidential, and accept that account deactivation or deletion is at Wavemaps’ discretion.  

4. License & Acceptable Use     We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, resell, decompile, reverse engineer, modify, or misuse any part of the App. All rights not expressly granted remain with Wavemaps and its licensors.  

5. Forecast Disclaimers & Assumption of Risk     5.1 No Warranties. Forecasts, models, visualizations, and data layers may be incomplete, delayed, or inaccurate. They are provided “as is” without warranties of any kind.     5.2 Use at Your Own Risk. You are solely responsible for how you interpret or act on the Services. Confirm conditions with official sources and exercise independent judgment.     5.3 No Professional Advice. The Services do not constitute navigation, weather, safety, or professional advice and should not replace qualified guidance.  

6. Subscriptions & Purchases    

In-app purchases and subscriptions are processed by Apple App Store or Google Play. Terms, billing, renewals, cancellations, and refund requests are handled through those stores. Subscriptions auto-renew until you cancel via the corresponding store settings.  

7. Third-Party Services    

The App integrates third-party services (e.g., Firebase, Mapbox, RevenueCat). Wavemaps is not responsible for third-party content, APIs, or policies. Your use of those components is governed by their terms.  

8. Limitation of Liability    

To the fullest extent permitted by law, Wavemaps and its officers, directors, employees, agents, partners, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or other  intangible losses arising from: (a) your use or inability to use the App; (b) reliance on any forecast or data; (c) errors or omissions in the Services; (d) unauthorized access or alterations. If liability cannot be excluded, our aggregate liability will not exceed the greater of US $100  or the amount you paid for the Services in the 12 months before the claim.  

9. Indemnification    

You agree to indemnify, defend, and hold harmless Wavemaps and its affiliates, officers, agents, partners, employees, and licensors from any claims, damages, losses, liabilities, costs, or expenses (including attorneys’ fees) arising from your use of the App, violation of these Terms,  or infringement of any third-party rights.  

10. Termination & Suspension    

We may suspend or terminate access immediately for any breach of these Terms or other reasons. You may stop using the App at any time. Sections intended to survive termination remain in effect.  

11. Modifications    

We may change features, pricing, or availability of the Services at any time without notice and update these Terms. Continued use after changes means you accept the updated Terms.  

12. Governing Law    

These Terms are governed by the laws of Puerto Rico, without regard to conflict of law rules. You agree to the exclusive jurisdiction and venue of the courts located in Puerto Rico.
